            다행히 A 씨는 부부 관계를 잘 소명했지만, 결국 A 씨는 남편을 상대로 사실혼 관계 파기 소송을 제기했다. 남편은 끝까지 “사실혼 관계가 아니다”라고 주장했으나, 재판부는 “사실혼 관계를 인정한다”고 판단했다.

            양지열 변호사는 “사실혼 관계인데도 재산분할을 인정했다는 건 빚이 한 사람이 일방적으로 진 게 아니라는 얘기다”라면서 “전남편이 빚을 안 갚고 있는 사이에 공동의 빚이 커지기 때문에 먼저 갚은 다음에 그 내용을 가지고 나중에 받아내는 수밖에 없어 보인다”라고 말했다.
